Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Evora IQ platform operated by Evora IQ ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms.

1. Nature of the Service — Advisory Tool Only

Evora IQ is an automated website analysis and advisory tool. We scan publicly accessible web pages and generate reports that highlight potential technical, legal, and accessibility issues. Our reports are provided for informational and advisory purposes only and do not constitute legal, regulatory, medical, financial, or professional compliance advice.

We act as a technology consultant, not as a lawyer, data-protection officer, HIPAA compliance officer, or certified accessibility auditor. Nothing in our reports creates a client–attorney or any other professional relationship. You remain solely responsible for verifying findings with qualified professionals and for achieving and maintaining actual compliance with applicable laws and regulations.

2. No Guarantee of Compliance

A high score or a "Pass" result in any Evora IQ scan does not mean your website is legally compliant, fully accessible, or free of risk. Our automated checks cover a subset of known patterns and rules; they cannot detect all possible issues. You must not rely solely on Evora IQ output to satisfy any regulatory or contractual obligation.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By using Evora IQ you represent that you meet these requirements and that all information you provide is accurate.

4. Account Registration

To access certain features you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@compliancepilot.com if you suspect unauthorised access.

5. Acceptable Use

You agree not to:

  • Scan websites you do not own or for which you have no authorisation;
  • Use the Service to harass, defame, or violate the rights of any third party;
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service;
  • Use automated scripts to exceed normal usage patterns or to circumvent rate limits;
  • Resell or sublicense access to the Service without our written consent;
  • Use the Service to generate content that violates applicable law.

6. Subscription, Billing and Refunds

Paid plans are billed monthly or annually in advance via Stripe or PayPal. Subscriptions renew automatically until cancelled. You may cancel at any time from your account dashboard; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods, except where required by applicable consumer protection law in your jurisdiction. Prices are shown exclusive of any applicable taxes; you are responsible for any VAT, sales tax, or similar levies.

7. Free Trial / Freemium Plan

The Free Trial plan allows one website scan using one selected module. Free plans are provided "as is" without warranty and may be discontinued or modified at any time. Free plan users agree to receive product-related emails; they may opt out at any time.

8. Intellectual Property

The Evora IQ platform, including its software, design, trademarks, and content, is owned by us and protected by intellectual-property laws. You retain ownership of any data you submit. You grant us a limited, non-exclusive licence to process your data solely to provide the Service.

9. Confidentiality of Scan Results

Scan reports are private by default and visible only to your account. Shareable public links, if activated, make the report accessible to anyone with the link. You are responsible for managing report visibility.

10. Third-Party Services

The Service integrates with third-party providers (Stripe, PayPal, AI inference APIs). We are not responsible for the availability, security, or conduct of these third parties. Their use is subject to their own terms and privacy policies.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

14. Modifications

We may update these Terms at any time. We will notify you by posting the new Terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Sections 8, 11, 12, and 13 survive termination.

16. Governing Law and Disputes

These Terms are governed by the laws of Portugal (EU). Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Lisbon, Portugal, subject to mandatory consumer-protection provisions that may apply in your country of residence.
